Diddy Appears in Court Regarding Jail Cell Search
The disgraced Hip Hop mogul faced a judge yesterday about a jail cell search that his defense team says was a violation of his rights to a fair trial.
According to reports, authorities seized 19 pages of handwritten notes from Diddy’s cell and prosecutors plan to use them as evidence against him. However, his lawyers claim the notes should be confidential under attorney-client privilege, which safeguards a defendant against self-incrimination.
Diddy’s lawyer, Marc Agnifilo, also claims that the search was unreasonable under the U.S. Constitution, but prosecutors say it was a pre-planned search of the jail facility and was conducted by multiple agencies. A detective secretly took photos of the notes during the search and then returned them to Diddy’s cell. Prosecutors claim that these handwritten notes are fair-game evidence, as they prove Diddy is attempting to pay off witnesses and obstruct justice. They are also accusing him of contacting witnesses while in jail.
The music star’s legal defense team now says they may pursue dismissal of the entire case or recusal of the prosecution team, while prosecutors say the handwritten notes could lead to more charges against Diddy.
The judge asked both sides to prepare written arguments about why the 19 pages of notes are or are not privileged communications. He also ordered the prosecution to delete the photographs until a determination is made and for jail officials to retain video footage of the search conducted in Diddy’s cell.
Diddy will appear in court again this coming Friday, where his lawyers will make a third argument for bail.
